Terms of Service

1. Agreement to terms

These Terms of Service (“Terms”) govern your access to and use of the mediazzy platform (the “Service”) provided by mediazzy (“we”, “us” or “our”). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other law that cannot lawfully be excluded.

2. Accounts and eligibility

You must provide accurate information when creating an account and keep it up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us promptly of any unauthorised use.

3. Acceptable use

You agree not to use the Service to:

  • publish content that is unlawful, misleading, defamatory, infringing or that breaches any third-party platform’s rules;
  • breach advertising, health-practitioner (including AHPRA) or other regulatory requirements that apply to your content;
  • attempt to gain unauthorised access to the Service, other accounts, or our systems;
  • interfere with or disrupt the integrity or performance of the Service; or
  • use the Service to send spam or to infringe the intellectual property or privacy rights of others.

You are solely responsible for the content you create, schedule or publish through the Service and for ensuring it complies with all applicable laws and platform policies.

4. Subscriptions and billing

The Service is offered on subscription plans (Starter, Pro and Enterprise) billed monthly in Australian dollars. By subscribing, you authorise us and our payment processor (Stripe) to charge the applicable fees to your nominated payment method on a recurring basis until cancelled.

Plan inclusions and limits (such as the number of brands and users) are described at the time of purchase. We may change pricing on reasonable notice; changes will not affect the current billing period.

5. Cancellation and refunds

You may cancel your subscription at any time from your billing settings. Cancellation takes effect at the end of your current billing period, and you will retain access until that date. Unless required by law, fees already paid are non-refundable and we do not provide pro-rata refunds for partial periods.

Nothing in this section limits your rights to a remedy (including a refund) where there is a failure to meet a consumer guarantee under the Australian Consumer Law.

6. Intellectual property

You retain ownership of the content you provide. You grant us a limited licence to host, process and transmit that content solely to operate the Service. We retain all rights in the mediazzy platform, software and branding.

7. Third-party platforms

The Service integrates with third-party platforms (including Meta, Google, LinkedIn and Stripe). Your use of those platforms is subject to their own terms, and we are not responsible for their availability, actions or changes to their APIs.

8. Service availability

We aim to keep the Service available but do not guarantee it will be uninterrupted or error-free. We may modify, suspend or discontinue features from time to time. Where an SLA applies to your plan, the terms of that SLA prevail to the extent of any inconsistency.

9. Limitation of liability

To the maximum extent permitted by law, and subject to any non-excludable rights under the Australian Consumer Law, we are not liable for any indirect, incidental, special or consequential loss, or loss of profits, revenue, data or goodwill, arising from your use of the Service.

Where our liability cannot be excluded but can be limited, our liability is limited (at our option) to resupplying the Service or paying the cost of having the Service resupplied. To the extent permitted by law, our total aggregate liability is limited to the fees you paid for the Service in the three (3) months preceding the event giving rise to the liability.

10. Termination

We may suspend or terminate your access if you breach these Terms or use the Service in a way that risks harm to us, other users or third parties. On termination, your right to use the Service ends, though provisions that by their nature should survive will continue to apply.

11. Governing law

These Terms are governed by the laws of Queensland, Australia, and you submit to the non-exclusive jurisdiction of the courts of that State and the Commonwealth of Australia.
